Abstract
Cet article décrit la situation juridique des conjoints de fait québécois afin non seulement d’en dresser le portrait le plus évocateur possible, mais également dans le but d’en faire ressortir les traits singuliers qui ont pour effet de les distinguer des autres couples qui ont adopté ce mode de vie ailleurs au Canada. Pour ce faire, il analyse le raisonnement juridique suivi par la Cour suprême du Canada dans une affaire célèbre connue sous l’appellation Éric c. Lola. Dans cette affaire, les dispositions du Code civil du Québec, qui n’accordent pas la même protection aux conjoints de fait et aux époux, ont été attaquées au motif qu’elles portaient atteinte au droit à l’égalité constitutionnellement protégé. La Cour a maintenu la constitutionnalité de la loi par une très courte majorité en se fondant, notamment, sur la nécessité de protéger la liberté et l’autonomie des personnes qui choisissent ce mode de vie pour ne pas être assujetties aux règles impératives du mariage. Or, se fondant sur des données quantitatives inédites, les auteures suggèrent que ce postulat pourrait bien être erroné.
