Abstract

Basée sur des recherches empiriques menées en Belgique dans différents lieux de la justice étatique auxquels des familles en contexte migratoire recourent de manière significative, la contribution se concentre sur l’analyse des questions que la diversité culturelle pose à l’administration de la justice étatique en les passant au tamis de différentes perspectives théoriques associées au concept de pluralisme juridique en anthropologie du droit. Du dépouillement et de l’analyse des données émergent deux formes principales de manifestations de la diversité culturelle dans l’exercice de la justice familiale : d’une part, l’invocation explicite d’un argument culturel dans les demandes des justiciables, et, d’autre part, des interactions beaucoup plus implicites et complexes que la seule évocation formelle d’une norme attachée à un ordre distinct. La discussion de ces résultats conduit les auteures à clarifier la portée et la pertinence théorique de deux manières d’appréhender le pluralisme juridique, entre paradigmes culturalistes et critiques, pour un champ des recherches en construction qui s’attachent à approfondir la compréhension de situations marquées à la fois par une forte judiciarisation des conflits familiaux et par la diversité ethno-nationale des sociétés occidentales.
