Abstract
Cette thèse propose une généalogie critique du sexe mâle/masculin (« M ») ou femelle/féminin (« F ») qui est catégorisé aux fins de l’état civil québécois. Pour ce faire, une étude des dispositifs qui permettent la répartition des personnes dans l’une ou l’autre des catégories susmentionnées est complétée. Celle-ci amène l’auteur à remettre en question ces idées généralement reçues en doctrine selon lesquelles le sexe ainsi catégorisé émanerait en tout ou en partie de la nature humaine. La revue des normes juridiques applicables à la détermination ainsi qu’à la modification de la mention du sexe figurant à l’acte de naissance le pousse plutôt à conclure que la qualification d’une personne comme étant de sexe mâle/masculin (« M ») ou femelle/féminin (« F ») s’explique seulement par l’action du pouvoir juridique. Il défend donc l’idée selon laquelle le sexe des personnes est toujours conditionné par l’action du pouvoir juridique, qui projette sur elles la catégorie sexuelle à laquelle elles sont rattachées.
