Abstract
La notion de « zone grise d’emploi » n’est pas inconnue des économistes du travail. On la retrouve dans de nombreux écrits pour souligner la persistance de l’emploi informel ou illégal dans les pays émergents. L’article reprend cette notion et en discute le bien-fondé au regard de la présence du phénomène au cœur de la relation d’emploi des principales économies de capitalisme avancé. La notion de zone grise d’emploi est appréhendée non pas comme un dysfonctionnement des règles juridiques qui encadrent la relation employé/employeur, mais comme une donnée structurelle caractéristique d’une nouvelle cartographie des relations de pouvoir et intimement liée aux chaines de valeur, à la stratégie et aux politiques de gestion des ressources humaines des firmes multinationales. En prenant le cas de la France, la notion de « régulation sociale sans compromis » est avancée et discutée pour souligner l’importance des zones grises d’emploi dans la mise en place d’une régulation managériale du dialogue social et de la relation d’emploi.
