Abstract
Dénoncer les limites et les insuffisances de la dogmatique est devenu une figure traditionnelle de la rhétorique doctrinale. Se bornant à jouer avec des abstractions vides, la dogmatique serait incapable de penser concrètement le droit et les enjeux socioéconomiques dans lesquels il s’insère. L’on peut pourtant rompre avec cette présentation critique, en pensant la dogmatique comme une activité artistique. Le dogmaticien pose un regard d’artiste sur la règle de droit, précisément en ce qu’il ne l’envisage pas comme un moyen, mais comme sa propre fin, la décollant par fiction du contexte de son apparition et de son application, créant ainsi un système autonome. L’art permet de comprendre en quoi cette déconnexion, tant critiquée par ailleurs, est néanmoins une vertu : source de créativité, condition de l’impartialité, vecteur de pacification.
