Abstract
A garantia dos direitos fundamentais é condição indispensável para a concretização do EstadoDemocrático de Direito, fundado pela Constituição Federal de 1988. Os direitos fundamentais sociaisdependem, para a sua realização, da elaboração e da implementação de políticas públicas, as quaissão incumbência constitucional dos Poderes Legislativo e Executivo. A atividade judiciária assegurariaa fruição desses direitos fundamentais em caso de inércia ou ineficiência dos demais entes estatais.Trata-se de uma reinterpretação do princípio da separação dos Poderes, com vistas a adequar o textoconstitucional à realidade. A superação de questões como a ilegitimidade democrática e o hiperativismojudicial será feita pelo maior preparo do magistrado em sua atuação, já que as decisões sobre a matériaexigem uma motivação qualificada. A reserva do possível deve ser reinterpretada para se adaptar àrealidade brasileira. Não é outro o entendimento dos tribunais superiores. O controle judicial depolíticas públicas em matéria de direitos fundamentais sociais, portanto, é legítimo.
