Abstract
Marqué par ses origines délictuelles, le street art pose aujourd’hui de nombreuses interrogations en droit, et ce, d’autant plus que le marché de l’art tend à le considérer comme un véritable mouvement artistique, au même titre que l’art contemporain par exemple. De par cette évolution, le droit pénal, le droit de la propriété intellectuelle et le droit de propriété au sens de l’article 544 du Code civil français sont nécessairement interrogés. Entre liberté de création et protection de l’ordre public et des droits d’autrui, le street art peut-il être rattaché aux catégories juridiques existantes ? Un statut juridique sui generis ne serait-il pas préférable ?
