Abstract

This article addresses the problems which surround setting temporary limits on human rights and freedoms when a state of emergency is declared in a given geopolitical area. The state of emergency, in action, is considered as a temporary regime which permeates the particular territory. In my article, I underline the necessity of adhering to principles of equity and law in the restriction of human rights under emergency regime conditions in certain areas. I also analyze the legal reasons for the limitation of human rights when an emergency is declared. I write not just about the norms of international law, the Russian Constitution and the legal code, but also about the specific requirements contained in various acts.
