Abstract
How should the law respond when concerns about equality collide with concerns for religious freedom? Both freedom of religion and equality rights are entrenched in the Canadian constitution, and the Supreme Court of Canada has said there is no hierarchy of constitutional rights. Professor Ginn considers what principles should be applied to find a just balance between equality and religious freedom. Discussion includes a focus on the recent Supreme Court of Nova Scotia decision, Trinity Western University v Nova Scotia Barristers' Society.
