The author discusses the importance of recent developments in Canadian law prohibiting discrimination on the basis of gender identity and gender expression. While we should not be naive about the extent of the transformation required before trans and gender diverse individuals are equal participants in all aspects of Canadian society, nor of the degree to which rights adjudication can advance the transformative project, these developments put in place a solid foundation for using human rights litigation to contribute to the realization of the many changes that are needed to reduce the violence, harassment and discrimination that are part of the daily experience of trans and gender diverse individuals.
