Abstract
La Cour supreme du Canada a recemment rendu un avis consultatif portant sur la procedure de modification constitutionnelle applicable a la reforme du Senat canadien. Le present texte offre une perspective historique expliquant le developpement des regles relatives aux modifications constitutionnelles concernant le Senat et les origines de la controverse qui a ete soumise a la Cour. Afin de trancher la controverse, la Cour supreme a du, pour la premiere fois depuis l�adoption de la constitution de 1982, preciser son interpretation de la formule de modification de la constitution. Se fondant sur le concept d�architecture de la constitution et, implicitement, sur une vision de la federation canadienne comme un pacte, la Cour a interdit au gouvernement federal d�agir unilateralement. La reforme du Senat, si elle a lieu, devra donc faire l�objet d�une entente entre le gouvernement federal et les provinces.
