Abstract
Si l’on reconnaît que ce sont moins les termes qui sont intraduisibles que les idées qu’ils véhiculent, il faut admettre que la traduction a moins pour objet de parvenir à une équivalence des termes qu’à un rapprochement des mondes, culturels et normatifs. Encore faut-il que cela soit possible. En effet, le droit, notamment international, est établi sur un arrière-plan topique occidental, peu comparable, voire compatible, avec celui des mondes autochtones, dans lesquels le juridique – généralement importé et imposé – n’est pas nécessairement la forme principale des modes de régulations sociétales. La traduction joue donc un rôle déterminant, tout à la fois dans les tentatives, nécessairement imparfaites, de rapprochement des mondes, mais également dans la reconnaissance – au sens d’acceptation à égale dignité et de respect – des diversités culturelles.
