Abstract
Faute de se prévaloir du droit des peuples à disposer d’eux-mêmes, les nations sans Etat opposent à la légitimité démocratique du constitutionnalisme libéral une légitimité historique fondée sur la permanence d’une identité forgée au fil du temps. Le problème politique et juridique soulevé par la revendication des nations sans Etat ne peut trouver sa solution que dans le cadre existant de la Constitution libérale positive. Or, ce cadre constitutionnel tel qu’interprété par le juge constitutionnel, peut s’avérer plus ou moins flexible (Canada, Ecosse), mais aussi particulièrement intangible (Espagne). Dans ce dernier cas, il tend à renforcer le présupposé historiciste des nations sans Etat.
