Número 102Septiembre - Diciembre 2001Nueva Serie Año XXXIVISSN 0041 8633 COMERCIO Y MEDIO AMBIENTE: APORTACIONES DESDE LA PERSPECTIVA DEL ACUERDO DE LIBRE COMERCIO CHILE-CANADÁ Sergio PEÑA-NEIRA * En la primera parte, el autor establece un marco teórico y expone las diferentes posturas de distintos sectores frente a las relaciones entre comercio y medio ambiente. El autor parte de que dicha relación ha superado el terreno estrictamente económico, para convertirse en un fenómeno cuya problemática y soluciones deben ser abordados por el derecho. De esta manera, el autor analiza la reglamentación y las soluciones existentes en materia ambiental en el Tratado de Libre Comercio entre Chile y Canadá, y en el Acuerdo sobre Medio Ambiente entre estos dos países, entre las que destacan los procedimientos de consulta, imposición de sanciones y de solución de controversias. Por último, el autor expone la regulación canadiense en cuanto al comercio marítimo y el medio ambiente, tomando en consideración las dificultades que puede traer aparejado el hecho de que la legislación canadiense en esta materia es más avanzada que la chilena. * Profesor ayudante en la Universidad del Mar, Chile, e investigador del Centro de Ecología Teórica y Aplicada de la citada casa de estudios.
