Abstract
Le régime autoritaire de Vichy comme la République restaurée de la Libération inaugurent leur avènement par les procès des dirigeants des régimes qui les ont précédés. Par-delà leurs différences, ces procès offrent une même caractéristique, celle d’être encadrés par des magistrats professionnels engagés dans des enjeux politiques auxquels ils ne sont pas habitués. Par-delà des différences importantes, la Cour suprême de justice (CSJ) de Vichy et la Haute Cour de justice (HCJ) de la République rétablie partagent un mélange de respect des principes judiciaires de droit commun et d’innovations dérogatoires empruntées à la justice politique.
