La personne qui règle un litige à l’amiable entend parfois recouvrer la somme qu’elle débourse. Ainsi, la caution peut réclamer le montant de la transaction au débiteur principal. Le débiteur solidaire qui transige avec le créancier peut réclamer la part de ses codébiteurs. Ces deux recours constituent des cas de subrogation légale. La prescription n’est donc pas acquise; elle a été interrompue par l’action du créancier. Dès lors, la créance transmise par le mécanisme de la subrogation pourra être recouvrée d’un autre débiteur. Le subrogé devra démontrer l’existence et l’étendue de cette créance. De plus, le créancier pourra parfois être préféré au subrogé pour le solde qui lui est dû. Même si une remise de la dette a eu lieu, les deux recours peuvent coexister, ce qui suppose qu’il n’y ait pas novation. Enfin, dans certaines hypothèses, la subrogation ne peut avoir lieu, quoiqu’une tierce personne soit tenue d’indemniser la personne qui transige. La jurisprudence nous conduit cependant au même résultat : celui qui transige ne pourra recouvrer plus que ce qu’il aurait obtenu sans régler le litige. Il devra faire la preuve de l’existence de la créance et démontrer que le montant de ses pertes n’aurait pas été moins élevé en l’absence de transaction.
