Abstract
L’analyse juridique de la liberte de religion, de la laicite et de la neutralite de l’Etat qui est proposee dans le present article est fondee sur l’hypothese que le droit s’ethicise en matiere religieuse. L’auteur tente de demontrer cette hypothese et pretend qu’elle offre une comprehension de l’evolution recente du traitement juridique des questions religieuses. Le projet de Charte affirmant les valeurs de laicite et de neutralite religieuse de l’Etat ainsi que d’egalite entre les femmes et les hommes et encadrant les demandes d’accommodement, constitue l’une des dernieres manifestations legislatives d’ethicisation du droit en ce domaine. Sur cette base, il convient de s’interroger sur les conceptions de la religion, de la laicite et de la neutralite de l’Etat contenues dans un tel projet de loi, sur la base d’un cadre d’analyse fonde sur l’ethique.
