Abstract
O presente estudo objetiva elaborar as bases introdutórias de uma filosofia jurídico-processual segundo Tomás de Aquino. Os julgamentos judiciais mereceram signifi cativo destaque no pensamento filosófico do aquinatense, culminando com o que podemos conceber por uma teoria geral do processo medieval-tomista, rompendo em definitivo com os resquícios dos processos ordálios e com os sempre polêmicos procedimentos dos tribunais da Inquisição. Assim é que a partir dos escritos consignados na secunda secundae da Suma Teológica. Tomás de Aquino efetivamente desenvolve uma doutrina do processo judicial, com institutos e categorias que afortunadamente perduram com grande proveito até os dias de hoje. Não obstante tal doutrina tenha se voltado sobretudo ao processo penal, há, sem dúvida, a possibilidade de projeção de suas generalidades para outros ramos do direito processual, designadamente para o processo civil.
