Abstract
La participation de l’auteur, depuis une trentaine d’années, à divers programmes canadiens mettant en jeu le rapport au droit en situation coloniale et post-coloniale a débouché sur une invitation à se joindre au programme « Peuples autochtones et gouvernance » pour y travailler sur la question des revendications territoriales des Premières Nations du Canada et tenter de remédier à leur aporie. D’un point de vue anthropologique, les rapports des autochtones aux territoires sont dominés par une représentation de l’espace « odologique », comme science des cheminements privilégiant une appropriation des ressources (fruits au sens juridique) là où le droit civil ou la common law reposent sur une approche « géométrique » et sur la propriété du fonds. Des perspectives judiciaires nouvelles semblent ainsi envisageables. L’auteur présente ici le cadre théorique général de la démarche, laissant à des collègues québécois le loisir d’en apprécier l’applicabilité.
