Abstract
La normatividad que rige en la actividad contractual en el Estado colombiano se ha modificado legal y reglamentariamente en varios aspectos, con la inclusión de disposiciones, como la que admite la realización de la subasta inversa en ciertas modalidades de selección. En desarrollo de una metodología exploratoria se recopiló y analizó regulación legal, doctrina, recomendaciones foráneas y jurisprudencia, con el propósito de especificar el marco legal vigente aplicable e identificar críticamente en el panorama colombiano, variables que podrían incidir en la competitividad y, por ende, en la participación, por fenómenos asociados a prácticas colusorias o de cárteles, para ampliar el conocimiento del procedimiento adoptado en las compras gubernamentales, con respecto a su utilización y a comportamientos de los sujetos en la actividad contractual.
