Abstract
Cet article porte sur les reformes recentes effectuees en France, en Belgique et au Quebec en matiere de residence alternee, d'hebergement egalitaire et de garde physique partagee. Quelles en sont les configurations ? Comment expliquer qu'elles tendent vers le meme modele de reconstruction de l'institution familiale ? Quels sont les impacts des reformes mises en place et quelles normativites sous-tendent-elles ? Une etude de cas multi-site a ete realisee en faisant appel a des sources primaires et secondaires diverses : analyse des nouvelles dispositions legislatives et administratives, analyse des etudes sur la question parues dans les trois juridictions civilistes, entrevues qualitatives aupres de parents, de mediateurs et de juristes quebecois. Dans les trois juridictions etudiees, l'ideal de l'egalite et de l'individuation au sein de la cellule familiale heterosexuelle a ete materialise en termes de garde physique partagee et celle-ci, a son tour, a ete transposee en termes de droit, precedant ainsi les changements sociaux et familiaux. Il s'agit ici de la premiere etude comparative de cet ordre ayant pour objet les transformations sociales liees a la garde partagee.
