Abstract
Cet article traite de la théorie des systèmes de Niklas Luhmann à partir de quatre concepts fondamentaux : communication, fonction, code et programme. Nous avons voulu spécifier les malentendus qui nuisent encore à l’exploitation du plein potentiel de chacun de ces concepts dans l’analyse empirique des systèmes sociaux de la société moderne. Nous avons par ailleurs porté une attention toute particulière à la question du changement et de l’évolution des systèmes, question souvent controversée dans l’analyse systémique. Le cas du système juridique sert d’arrière-plan à l’analyse proposée, mais nos observations restent pertinentes pour l’étude empirique de phénomènes se rapportant à d’autres systèmes sociaux fonctionnellement différenciés.
