Abstract
Depuis le début des années 2000, la Cour suprême du Canada a consacré trois arrêts à la protection contre la discrimination dans l’emploi fondée sur les antécédents judiciaires. L’auteur démontre que, chaque fois, la Cour a retenu une interprétation de la Charte québécoise plus restrictive que celle privilégiée par des membres du Tribunal des droits de la personne, auxquels le législateur reconnaît pourtant « une expérience, une expertise, une sensibilisation et un intérêt marqués en matière de droits et libertés de la personne ». Cela étant, le moment serait-il venu, pour le législateur québécois, de revoir le libellé de la Charte de manière à lui (re)donner une portée plus généreuse à cet égard ?
