Abstract
Notre jurisprudence sur le boycottage vient de s'enrichir d'un arrêt de la Cour suprême. C'est l'affaire de Seafarers International Union of North America, Canadian District v. Joseph Stern (1). L'arrêt porte aussi sur une intéressante question de procédure : la portée de l'article 81a du Code de procédure (2) donnant un mode d'assignation de tout groupement de personnes associées pour la poursuite en commun de fins ou avantages d'ordre matériel, commercial ou professionnel, qui ne possède pas dans la province de personnalité civile collective et n'est pas une société au sens du Code civil. (1) (1961) S.C.R., p. 682. L'arrêt de la Cour d'appel est rapporté à 1960, B.R., p. 901. (2) A venir à la Loi 8-9 Eli. II, ch. 90, art. 6, votée à la session de 1959-1960, ce texte faisait partie de la Loi concernant certaines matières spéciales relatives à la procédure. S.R.Q. (1941), ch. 342, originairement la Loi favorisant l'exercice de certains droits, 2 Geo. VI, ch. 96, cotée en 1938.
