Abstract
Quels sont les impacts réels de la Charte canadienne en matière de droits linguistiques ? Son adoption a-t-elle réellement participé au recul du fait français au Québec et amoindri la portée de la loi 101 ? C’est ce que croient de très nombreux Québécois et, depuis les années 1970, cette croyance s’est érigée en doxa chez les nationalistes indépendantistes ; chez les nationalistes fédéralistes du Québec, elle fait figure de tabou… Mais qu’en est-il vraiment ? En analysant minutieusement lois, règlements, décisions de la Cour suprême et autres déclarations de politiciens, Frédéric Bérard déconstruit patiemment le mythe créé et entretenu par la doctrine québécoise du nationalisme « méthodologique » en matière de droits linguistiques. Il révèle non seulement que les seuls « gagnants » des débats juridiques relatifs à ces droits, depuis 1982, sont les francophones hors Québec, mais il met aussi en lumière les limites du droit à protéger ou à promouvoir une culture, quelle qu’elle soit. Sans sombrer dans l’angélisme, l’auteur met cet épineux débat en contexte : il livre un historique pré-charte et s’attarde sur le traitement controversé qu’ont fait subir les différents gouvernements du Québec aux minorités francophones du pays.
