Abstract
The New Zealand Bill of Rights Act 1990 makes no reference to 'equality before and under the law', as expressed in section 15 of the Canadian Charter of Rights. The White Paper that came before the Bill of Rights Act suggested that the general idea of equality before the law was implied in the proposed bill to New Zealand being founded on the rule of law. The author argues that the liberal notion of freedom as the right to be free of legal disability cannot bring equality under law. This concept of the unequal effect of apparently equal laws and its impact on New Zealand's growing multiculturalism is discussed.
