Abstract
O presente artigo discute a aplicabilidade da Convenção de Montreal na responsabilidade civil decorrente de contratos de transporte aéreo internacional no Brasil, frente às disposições apresentadas pelo Código de Defesa do Consumidor e pelo Código Civil sobre a responsabilidade do transportador e à matriz constitucional desses diplomas. Esta análise apresentará um panorama destes conflitos tanto sob a ordem jurídica interna quanto na visão do Direito Internacional, de modo a delinear os fundamentos para aplicação do citado acordo internacional em sobreposição às regras gerais do CDC e do Código Civil e as consequências de sua não aplicação.
