O presente trabalho científico tem como escopo o exame didático dos recentes precedentes judiciais no tocante à nomeação dos candidatos aprovados em concurso público. Tais decisões consideradas históricas pela comunidade acadêmica acabam por mudar o entendimento há muito consolidado na cúpula do Judiciário brasileiro. Capitaneada pelo Tribunal da Cidadania, em seguida acompanhada pela 1ª Turma do Pretório Excelso, o direito à nomeação, antes considerado como mera expectativa de direito, passa a sofrer uma nova exegese, beneficiando assim os concursados aprovados, que passariam a ter o direito subjetivo à nomeação, sendo este ato administrativo vinculado ao edital. De sorte, analisa-se a repercussão dos citados julgados na sociedade e na Administração Pública brasileira, bem como sua adequação aos dispositivos constitucionais esculpidos nos art. 37, em seus incisos II, III e IV, além de uma evolução histórica do pensamento dessas Cortes, das Constituições brasileiras, bem como o posicionamento da doutrina abalizada sobre o presente tema.
