O presente trabalho trata da questão da publicidade dirigida às crianças na sociedade de consumo, no Brasil, tendo em vista que esta não é proibida de forma expressa, analisando-se o Código de Defesa do Consumidor, a Resolução nº. 163 do CONANDA e o artigo 5º do Estatuto da Primeira Infância. Para tanto, ressalta-se que as crianças e os adolescentes se encontram em processo de desenvolvimento e formação de sua personalidade e as influências sofridas na infância são determinantes para as escolhas e comportamento na vida adulta. Além disso, também se enfatiza a doutrina da proteção integral e a hipervunerabilidade da criança, realizando-se um contraponto com a legislação da Província de Québec, no Canadá, especificamente os dispositivos pertinentes à publicidade dirigida à criança na “Loi sur la protection du Consommateur”, justamente porque proíbem esta publicidade para os menores de treze anos, com raras exceções.
