L’instauration de droits de propriété sur les données personnelles : une légitimité économique contestable

Abstract
Les données personnelles sont au cœur d’une attention croissante portée par les industries numériques. Pour les plateformes développant un modèle d’affaires sur plusieurs versants, les modalités de collecte, traitement et valorisation de ces données ouvrent la possibilité d’une rentabilité accrue et d’un contrôle renforcé sur le marché. Dans ce contexte, l’idée d’un droit de propriété, accordé aux individus, a été soulevée, dans l’objectif de favoriser la protection de leur vie privée et un partage de valeur. Une étude de cette idée suivant une perspective de « law and economics », revenant notamment aux sources du droit de propriété, permet néanmoins de soulever les incohérences de cette proposition, et de plaider pour d’autres voies afin de concilier développement économique et respect de la vie privée.
