In the post-COP21 era, the idea of interconnecting carbon markets is arousing growing interest within the debate over which mitigation strategies to implement. Emissions trading schemes (ETS) are expanding rapidly – be it at the national or subnational level – and establishing links between these instruments is frequently envisioned as a promising avenue for fostering their efficiency. However, creating a global network of carbon markets may be easier said than done. Transferring carbon units from a market to another raises a number of legal issues that must be addressed through the development of a robust legal framework. Drawing upon the experience of the linkage between the California and Québec cap-and-trade programs, this paper provides an overview of the major hurdles that legal frameworks governing ETS linkages can expect to encounter.
