Abstract
Qu’est-ce qu’un « service écologique » en droit et, plus précisément, en droit privé des biens? Quelle qualification juridique et, en particulier civiliste, conférer aux « services écologiques »? Nous formons ici l’hypothèse que ces bienfaits de la nature constituent des fruits au sens du droit civil français, c’est-à-dire des choses régulièrement produites par d’autres choses sans altération de la substance de celles-ci. Plus précisément, nous soutenons que le triptyque des fruits naturels, industriels et civils pourrait correspondre à celui des services écosystémiques, des services environnementaux et des paiements pour services écologiques. Autrement dit, nous examinons dans quelle mesure les services écosystémiques — ces avantages procurés par un écosystème à d’autres écosystèmes ou aux sociétés humaines — forment de nouveaux fruits naturels, les services environnementaux — ces avantages qu’apportent les Hommes aux écosystèmes — de nouveaux fruits industriels, et les paiements rendus pour ces services, de nouveaux fruits civils.
