Abstract
Diante da descoberta científica da destruição da camada de ozônio e seus efeitos desastrosos à saúde humana, plantas e animais, surgiu a necessidade de enfrentamento global do problema e as tratativas internacionais evoluíram para a construção de um regime jurídico internacional, iniciado em 1985, com a Convenção de Viena para a Proteção da Camada de Ozônio e aperfeiçoado dois anos depois com o Protocolo de Montreal sobre as Substâncias que Destroem a Camada de Ozônio, que completa 30 anos. Atualmente, a partir dos acordos, o comércio de substâncias que destroem a camada de ozônio (SDOs) teve que ser reduzido em todo o planeta, seguindo-se cotas pré-definidas, ao mesmo tempo em que foram desenvolvidas tecnologias alternativas para reduzir ou eliminar os riscos à camada de ozônio. O presente artigo tem como objetivo analisar o regime jurídico do ozônio ao longo dos trinta anos de vigência do Protocolo de Montreal, com destaque ao exercício da governança desenvolvido ao longo do período, que permitiu uma participação ampliada e foi capaz de encontrar alternativas seguras ao enfrentamento do problema, destacando sua contribuição para o Direito Ambiental Internacional, como exemplo de tutela participativa e eficiente.
