Abstract
Le transsystémisme est une méthode d’enseignement simultané et comparé de la Common law et du droit romaniste mise au point par l’Université Mc Gill de Montréal. Cette méthode a une signification historique, car elle établit, pour la première fois, une communication scientifique entre les deux traditions juridiques de l’Occident, communication qui fait émerger leur souche commune. C’est une approche originale du droit commun, d’inspiration anglaise : elle ne consiste pas à unifier mais à mettre au jour ce qui est commun, tout en respectant ce qui est différent, montrant à la fois l’unité et la diversité du droit occidental. L’article met l’accent sur l’opportunité d’une archéologie des sources romaines communes dans les développements futurs de cette méthode. Il met aussi incidemment en évidence les racines communes du ius commune et de la Common law.
