Abstract
Depuis son entrée en vigueur en 1994, l’ALÉNA a été vivement critiqué par plusieurs, notamment en raison de son chapitre 11 relatif aux investissements. Ce chapitre prévoit des dispositions protègeant les droits économiques des investisseurs étrangers contre les décisions législatives des États membres. Lorsque les droits économiques des investisseurs étrangers sont affectés par une décision du gouvernement d’un État membre, ceux-ci peuvent intenter des procédures devant des tribunaux d’arbitrage afin d’obtenir des compensations financières, et ce, même si le gouvernement légifère en fonction de l’intérêt de la population. Même si la Charte canadienne ne protège pas les droits économiques, les lois qui sont votées par un gouvernement démocratiquement élu peuvent être contestées par les investisseurs étrangers en vertu des dispositions du chapitre 11 de l’ALÉNA. Ces droits et recours octroyés aux sociétés étrangères et leur impact sur la capacité des États signataires de légiférer librement soulèvent une question importante à laquelle ce mémoire tente de répondre: le chapitre 11 de l’ALÉNA porte-t-il atteinte à la démocratie?
