Le droit étatique et la certification équitable : des rapports d’hétéronomie

Abstract
Bien qu’elle émane d‘entités privées et qu’elle soit administrée uniquement par ces dernières, la certification équitable Fairtrade International entretient de nombreux rapports avec le droit étatique. Ces rapports se traduisent, entre autres, par une relation d’hétéronomie. Sur plusieurs aspects, la certification équitable sert le droit d’origine étatique, international et national, alors que sur d’autres elle en bénéficie. Le présent article propose de tracer un portrait de ces rapports. Dans un premier temps, l’auteure mène une étude comparative des normes de la certification Fairtrade International sur une période de dix ans (2007-2017), ce qui lui permet de constater une évolution du rapport entre la certification et le droit international. La relation qu’entretient la certification équitable avec le droit est tout aussi importante avec le droit interne des pays producteurs qui constitue, sous de nombreux angles, un point de référence. Dans un second temps, l’auteure démontre, par une analyse du contrat de certification conclu entre les acteurs de la certification équitable, que le droit interne allemand peut se révéler très utile au régime de certification de Fairtrade International.
