Abstract
Si du haut de notre modernité largement sécularisée il n’y a rien de mieux qu’un droit linguistique pour protéger une langue nationale, comme il n’y a rien de mieux qu’un État pour organiser une nationalité, peut-être semblait-il en être autrement au mitan du XIXe siècle, au carrefour du siècle des nationalités et du renouveau religieux ultramontain, alors que les droits linguistiques n’existaient pas encore. C’est à cette thèse que nous nous consacrerons dans ce texte, à savoir qu’au moment du pacte confédératif les droits religieux contenaient, englobaient les droits linguistiques, et que ceux-ci préfiguraient la dualité nationale. À cette fin, nous restituerons le contexte religio-politique de l’époque, au premier chef la conscience politique de l’Église-nation canadienne-française, dont la doctrine ultramontaine informe une certaine idée de la souveraineté de l’Église, du rôle des nations, et des fonctions dévolues à l’État et à la société civile, et ce, jusque dans la pensée nationaliste et ultramontaine d’Henri Bourrassa, théoricien de la dualité nationale.
