Studi ini membahas tentang tiga hal terkait dengan kedaulatan terhadap wilayah laut, yaitu: Apa makna kedaulatan negara atas wilayah; bagaimana Pemerintah Indonesia menegakkan sanksi pembakaran dan penanggulangan terhadap kapal nelayan asing yang melakukan pelanggaran di wilayah laut Indonesia; dan apakah pembakaran dan penenggelaman kapal asing tersebut bertentangan dengan hukum laut internasional 1982. Metode penelitian yang digunakan dalam studi ini adalah yuridis-normatif melalui pendekatan komparatif dengan praktek Australia dalam menangani nelayan Indonesia yang melanggar wilayah laut Australia. Hasil penelitian ini menunjukkan bahwa luas wilayah laut Indonesia yang menempati posisi kedua setelah Kanada, membuat Indonesia sangat memperhatikan wilayah teritorial lautnyayang tidak saja memiliki makna penting terhadap kedaulatan negara, tetapi juga terhadap sumber daya laut yang terkandung di dalamnya. Oleh sebab itu, dalam kasus pembakaran dan penenggelaman kapal asing yang melakukan pelanggaran terhadap wilayah laut Indonesia, Pemerintah meyakini bahwa hal itu merupakan bagian dari penegakan kedaulatan negara dan tidak bertentangan dengan hukum laut Internasional. This study discusses three matters related to sovereignty over sea territory, namely: what is the meaning of state sovereignty over territory; how the Government of Indonesia enforces burning and ship sinking against foreign fishing vessels committing violations in the Indonesian sea territory; and whether the burning and sinking of foreign ships contradicted to United Nation on the Law of the Sea (UNCLOS 1982). The research method used in this study is juridical-normative through a comparative approach to Australian practice in handling Indonesian fishermen who violate Australian sea territory. The results of this study indicate that the area of Indonesian sea that occupies the second position after Canada, make Indonesia very concerned the sea territory-which not only has significance to the state sovereignty, but also to the marine resources contained therein. Therefore, in the case of burning and shinking of foreign vessels violating Indonesias sea territories, the Government believes that it is part of the enforcement of state sovereignty and is not contrary to the UNCLOS 1982.
