Abstract
Le développement de la justice pénale internationale, comme branche incidente des processus de maintien de la paix, ne laisse pas indifférents les Africains, particulièrement concernés par les violations graves du droit international humanitaire occasionnées par les conflits armés. L’Union africaine, dont l’Acte constitutif fait du rejet de l’impunité un principe fondamental, plaide, depuis les divergences politiques qui ont entravé la collaboration de ses membres avec la Cour pénale internationale, pour une régionalisation accélérée de la répression pénale internationale. Cet article a pour objectif d’apprécier les enjeux juridiques de cette africanisation de la justice pénale motivée par de nombreux facteurs politiques.
