Abstract
Cet article discute du rôle des recours en réparation d'un préjudice, judiciaires ou extrajudiciaires, dans la régulation des produits et des services financiers destinés aux particuliers à la lumière des réglementations adoptées depuis une quinzaine d'années. Les recours en réparation sont complémentaires des réglementations et constituent un mécanisme de contrôle a posteriori des produits et des services, susceptibles de présenter un avantage de coût intrinsèque sur les contrôles a priori dans la dissuasion des comportements inappropriés chez les prestataires de services financiers.
