Abstract
C’est surtout sur des forums universitaires ou intellectuels français que la formule « nouvelle laïcité » est débattue depuis la première controverse sur le port du voile islamique à l’école publique en 19891. Pourtant, sur le seul plan juridique, la laïcité française ne saurait être qualifiée de « nouvelle », au risque de l’essentialiser en la réduisant à certains de ses aménagements particuliers liés aux conditions d’expression individuelle des croyances. Dans une perspective sociologique, l’expression « nouvelle laïcité » est toutefois un outil d’analyse pertinent des déplacements des débats sociaux et politiques sur la laïcité et de leur influence, le cas échéant, sur la norme juridique française. À des fins comparatives, cet outil peut également être mobilisé pour éclairer d’autres contextes nationaux. C’est le cas du Québec où émergent de nouveaux discours et aménagements juridiques laïques depuis une douzaine d’années.
