Abstract
Depuis 2001, le Code des professions permet aux professionnels de se regrouper au sein d’une société en nom collectif à responsabilité limitée (s.e.n.c.r.l.) ou d’une société par actions (s.p.a.). Ce texte propose, dans un premier temps, de faire le point sur la responsabilité civile de la société et des professionnels ayant choisi l’une de ses formes juridiques pour exercer leur profession. Dans un deuxième temps, il y est question des principales protections d’assurance de responsabilité qui s’imposent à ces nouvelles sociétés de professionnels. L’auteur fait notamment état du fait que si l’assurance de responsabilité professionnelle obligatoire peut s’avérer suffisante pour protéger le public, elle suffit rarement à protéger le patrimoine des professionnels et de leurs sociétés.
