Abstract
Cet article aborde, d’un point de vue technique, les conditions d’enregistrement au Canada d’une couleur comme signe permettant de distinguer les produits ou services d’une personne de ceux des autres. La facon dont une couleur est revendiquee comme caracteristique de la marque, qu’elle soit bidimensionnelle ou tridimensionnelle, influera beaucoup sur l’obtention de l’enregistrement et la portee de celui-ci. Certaines imprecisions de la pratique canadienne sont par ailleurs soulevees, notamment a la lumiere de prochaines modifications legislatives. This article discusses, from a technical point of view, the conditions for registering a colour in Canada as a sign that distinguishes one person’s products or services from those of others. The way in which a color is claimed as a feature of the mark, whether two-dimensional or three-dimensional, will greatly influence the obtaining of the registration and the scope thereof. Some inaccuracies in the Canadian practice are also raised, particularly in the light of upcoming legislative changes.
