Abstract
O fundamento jurídico dos direitos humanos positivados é um princípio ideal ou uma construção? Eu gostaria de examinar essa questão a seguir. Isso deverá ocorrer por meio de duas teorias dos direitos humanos: a teoria de Hans Joas sobre a "sacralidade da pessoa" como base dos direitos humanos e a construção política da "ideia de direitos humanos" de Charles R. Beitz. Enquanto Joas considera a dignidade humana como fundamento "sagrado" dos direitos humanos (II.), ela não tem lugar no construtivismo de Beitz (III.). Em contrapartida, apresentarei então uma posição intermediária na forma da construção da dignidade humana como fundamento dos direitos humanos (IV.). Mas eu inicio apresentando brevemente a estrutura dos direitos humanos (I.). Isso é necessário para que não se perca o foco jurídico da investigação: ela deve ser uma reconstrução jusfilosófica e não ética geral ou teológica dos fundamentos dos direitos humanos. Assim, ela não indaga como os direitos humanos devem ser com relação à ética, à teologia ou à política – mesmo que sem dúvida essas sejam questões legítimas e importantes para filósofos, teólogos e cientistas políticos. O filósofo do direito antes analisa na ética jurídica valores e normas transformadas em direito e assim as oferece para a crítica ou justificação pelas referidas disciplinas vizinhas.
