O artigo discute as transformações operadas na forma de realização do controle de constitucionalidade nas jurisdições européias. Analisa-se principalmente a transição de uma tradição de controle constitucional meramente negativo (Estado Liberal) para um novo modelo de controle também positivo (Estado Social), o controle hermenêutico (da interpretação das normas) e o controle determinador de produção legislativa. São mostrados alguns problemas do novo modelo e sugeridas soluções como a maior integração entre a atuação do Tribunal Constitucional e do Poder Legislativo em cada país europeu.
