Abstract
Deseo expresar mi más cumplido agradecimiento a los organizadores de este encuentro de juristas, por la oportunidad que me brindan para participar en este foro, cuya finalidad es el intercambio de opiniones sobre un tema que es a la par actual y trascendente, y que impacta no solamente a la ciencia del derecho, sino a la estructura básica del Estado mexicano y a su vocación republicana y democrática; es aquí donde se inserta, a mi juicio, la regulación de la transparencia y acceso a la información en su aspecto judicial.Potestad del derecho es hacer realidad la justicia y para alcanzarla requiere necesariamente de una sociedad ordenada, donde impere la paz.La afortunada frase de Francesco Carnelutti: ''Cuando el derecho nace, muere la guerra'', conceptúa brevemente la función ordenadora de la norma jurídica.En una sociedad abierta al caos, la concordia de sus miembros naufraga y afloran el roce de pasiones e intereses, propiciando la lucha y la negación misma del Estado de derecho.
