Abstract
La présente étude vise à exposer le cadre juridique applicable aux conseillers ministériels en France qui, malgré différentes dispositions législatives adoptées depuis les années 2000, demeure encore largement lacunaire et reste, pour une large part, en complet décalage avec l’importance du rôle qu’ils jouent dans le fonctionnement de l’institution gouvernementale. Les récentes réformes marquent toutefois des progrès notables vers une plus grande publicité ou transparence, notamment des conditions entourant la nomination des conseillers et leur rémunération, mais aussi vers une meilleure prévention et une meilleure sanction des entorses à la probité ou l’intégrité, principalement en luttant contre les enrichissements illicites et le conflit d’intérêts.
