La sédentarisation a, entre autres effets, favorisé la création d’institutions territorialisées. Parmi elles, l'État, qui dispose d’une place centrale, est souverain et, du fait de cette qualité, il exerce son pouvoir sur un territoire aux frontières définies et sur la population qui y réside. Dès lors, la mobilité contrainte de l’éventuel nomade climatique se heurte à des frontières étatiques. Les changements climatiques provoquent et provoqueront en effet des déplacements de populations soit à l’intérieur de leur pays d’origine soit vers d’autres territoires étatiques. Le droit international ne contient pas de réglementation spécifique relative à ces migrants climatiques. Examinés en l'occurrence sous l’angle de la souveraineté des États, les mouvements de population causés par les changements climatiques concernent les compétences des États touchés par ces changements et celles des autres États susceptibles d’accueillir ces migrants. Les déplacements internes de population pour raisons climatiques doivent respecter les droits des personnes affectées, mais relèvent, sauf exception, de la compétence souveraine de l'État concerné. En revanche, la souveraineté de l'État submergé dont la population se réfugie sur d’autres territoires terrestres est mise en cause. Quant aux autres États, les migrations climatiques les amènent à définir souverainement une politique relative à ces flux migratoires et à éventuellement envisager ou procéder à des aménagements institutionnels pour la présence de ces migrants.
