Abstract
Veliku pozornost stručne javnosti izazvale su odluke Europskog suda u predmetima Viking i Laval, u kojima je sud raspravljao o odnosu između socijalnih prava, konkretno prava na poduzimanje kolektivnih akcija i temeljnih tržišnih sloboda na kojima se temelji gospodarska integracija. Nasuprot pravu poduzetnika na slobodan zbor poslovnog nastana i pružanje usluga u onoj državi članici u kojoj su operativni troškovi najpovoljniji, s jedne strane, nalaze se prava radnika da, koristeći se svojim temeljnim pravom na udruživanje i poduzimanje kolektivnih akcija radi zaštite od prijetećega gubitka radnih mjesta i promjene uvjeta rada, utječu na izbor poduzetnika, s druge strane. Uspostavljanje ravnoteže između ovih oprečnih interesa socijalno je osjetljivo pitanje, a pristup njegovu rješavanju imat će značajne učinke i u kontekstu članstva Republike Hrvatske u Europskoj uniji.
