Abstract
La question de la restitution des biens culturels occupe souvent une place de choix dans l’actualité. Le sujet passionne par la multitude des problématiques qu’il prend en compte. L’internationalisation des relations, la complexification des situations, la diversité des enjeux historiques, politiques, diplomatiques, économiques ou spirituels sont autant de variables à analyser pour comprendre le phénomène de la restitution d’un bien culturel. Si les instruments juridiques internationaux, européens et nationaux sont nombreux, le droit se révèle aujourd’hui impuissant pour faire face aux revendications. C’est au travers d’une analyse historique, juridique et politique du droit des restitutions de biens culturels, basée sur quelques cas emblématiques, que cet article propose un état des lieux de la question.
